Leonard D. Flanagan

Mr. Flanagan is a graduate of the University of Washington School of Law, and has practiced law in the Seattle area for 27 years as a litigator of construction defect claims, insurance coverage disputes, contract negotiation and disputes, personal injury claims, corporate dissolution and liability issues, as well as professional negligence claims.  Mr. Flanagan is well known as an aggressive and creative litigator.  He recently tried what is believed to be the first professional negligence claim against a structural engineer in the State of Washington brought by consumers who did not hire the engineering firm, and secured a jury verdict for his clients in excess of $1.2 million.

Mr. Flanagan also has an extensive record of successful appellate advocacy.  He was counsel for a homeowner’s association in Chadwick Farms v. FHC, LLC, which established a right of action against individual members of a limited liability company who fail to take reasonable steps to properly wind up the business and address its outstanding warranty obligations before terminating the company’s existence.  Recent matters include a decision of the Court of Appeals in Alexander v. Sanford, upholding a claim for damages brought by Mr. Flanagan on behalf of many individual condominium homeowners against the condominium developer and former association board members for failing to prosecute timely warranty claims despite warnings of serious concealed defects at the project, which had led to the imposition of a large special assessment for repairs on his clients.

 

Kenneth W. Strauss

Since 1999, Mr. Strauss has focused his practice on community associations, serving hundreds of associations in Western Washington as well as California. His practice includes general counsel services, construction defect litigation, dispute resolution, contract negotiation and formation of non-profit corporations. He has served as lead trial counsel for condominium associations, as well in arbitrations relating to both construction defects and enforcement of governing documents. He is licensed in Washington, California and Oregon and is a frequent speaker on all topics relating to community association law and contributor to the WSCAI Journal.
